1. Parties and Agreement
These Terms and Conditions of Sale (“Terms”) govern all purchases of goods from Nona International (Pty) Ltd, a company registered in South Africa (Registration No. 2020/443239/07), trading as Nona International (“Nona International”, “we”, “us”, “our”), by any customer (“you”, “your”).
By placing an order or making a purchase through any of our sales channels — whether in-store, online, by telephone or email, or at a pop-up shop, market or event — you agree to be bound by these Terms. Please read them carefully before purchasing.

2. Scope and Sales Channels
These Terms apply to all sales of goods made by Nona International through any of the following channels:
- Physical retail store — Shop 29, Sandton Gate Central, 26 Sandton Gate Drive, Sandton, Johannesburg;
- Online store at www.nona-international.co.za;
- Telephone and email orders placed directly with Nona International;
- Pop-up shops, markets, trade shows and events at which Nona International trades.
These Terms are subject to the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) where applicable. Any rights afforded to you by law that cannot be excluded or limited are preserved in full.
3 Products and Product Descriptions
3.1 Product Information
We take reasonable care to ensure that all product descriptions, images, dimensions, materials and pricing displayed in our store and on our website are accurate. However, minor variations in colour, finish and appearance may occur due to photography, screen display settings, and the artisanal nature of some of our products.
Product images are for illustrative purposes only. We do not warrant that product images will be an exact representation of the physical goods you receive, particularly for handcrafted, hand-painted or imported tableware and homeware where natural variation is inherent to the product.
3.2 Availability
All products are offered subject to availability. We reserve the right to withdraw or modify any product or service without notice. Where a product is listed as available and subsequently becomes unavailable after your order is placed, we will notify you promptly and offer you a full refund, an alternative product, or a credit note at your election.
3.3 Imported and Special-Order Products
Many of our products are imported to order from international suppliers including Serax (Belgium) and ASA Selection (Germany). Lead times for imported or special-order items will be communicated to you at the time of ordering. Estimated lead times are given in good faith but are subject to supplier production schedules, shipping and customs clearance, which are outside our control.
4. Pricing and Payment
4.1 Prices
All prices are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the applicable rate, unless expressly stated otherwise. Prices are subject to change without prior notice. The price applicable to your order is the price confirmed at the time your order is placed and payment is received.
We reserve the right to correct any pricing errors. Where an item has been priced incorrectly due to a manifest error, we will notify you before processing payment and give you the option to proceed at the correct price, or to cancel and receive a full refund.
4.2 Accepted Payment Methods
We accept the following payment methods:
- Credit and debit card (Visa, Mastercard) — in-store and online via our secure payment gateway;
- Electronic Funds Transfer (EFT) — for confirmed orders, subject to proof of payment;
- Cash — in-store only;
- Such other payment methods as we may make available from time to time.
All online card transactions are processed by a PCI-DSS compliant third-party payment gateway. Nona International does not store, process or have access to your full card details.
4.3 Deposits
For special orders, imported goods or corporate orders, we may require a deposit of up to 100% of the order value at the time of placing the order. Deposit terms will be communicated to you in writing at the time of order confirmation. Deposits are non-refundable except as set out in these Terms or as required by law.
5. Orders and Order Confirmation
5.1 Placing an Order
An order placed by you (whether in-store, online, by telephone or email) constitutes an offer to purchase goods from us on these Terms. A binding agreement of sale is formed only when we accept your order and receive payment (or a deposit where required). We reserve the right to decline or cancel any order at our discretion, in which case any payment received will be refunded in full.
5.2 Order Confirmation
Where an order is placed online or by telephone or email, we will send you a written order confirmation to the email address you provide. Please review your order confirmation carefully. Any discrepancies must be reported to us at info@nona-international.co.za within 24 hours of receipt.
5.3 Cancellation by You
Once an order has been confirmed and payment received, cancellation is subject to the following:
- Standard in-stock items: you may cancel within 24 hours of order confirmation for a full refund. After 24 hours, a restocking fee of up to 15% of the order value may apply.
- Special orders, imported goods, and custom items: cancellation fees apply as set out in Section 7 below and in our Returns, Exchange & Refund Policy, and may equal up to 100% of the order value where goods have been produced or dispatched by our suppliers.
- Direct marketing purchases (pop-up, market, telephone or email solicitation): you have a five (5) business day statutory cooling-off right under Section 16 of the CPA. No cancellation fee applies within this period.
6. Delivery
6.1 Delivery Areas
We offer delivery of online, telephone and email orders within South Africa. International delivery is not currently offered as a standard service but may be arranged for corporate clients on request. Delivery is not applicable to in-store or pop-up purchases collected by the customer.
6.2 Delivery Fees
Delivery fees are calculated at checkout based on the delivery address and order size. Delivery fees are displayed before payment is confirmed. We reserve the right to amend delivery fees from time to time.
6.3 Delivery Times
Estimated delivery times will be communicated at checkout or at time of order confirmation. Delivery timeframes are estimates only and are subject to courier availability, public holidays and circumstances beyond our control. We do not guarantee delivery by a specific date unless expressly agreed in writing.
For imported and special-order products, lead times may range from four (4) to sixteen (16) weeks or more, depending on the supplier and shipping route. We will keep you informed of any material changes to expected delivery dates.
6.4 Risk and Ownership
Risk in the goods passes to you upon delivery and acceptance of the goods. Ownership (title) of the goods passes to you only upon receipt of full payment. Until full payment is received, we retain title to the goods.
6.5 Delivery Inspection
Please inspect your delivery immediately upon receipt. If goods arrive damaged in transit, you must notify us at info@nona-international.co.za within 48 hours of receipt, with photographs of the damaged goods and packaging. Failure to notify us within this period may limit your ability to make a claim for transit damage. This does not affect your statutory rights in respect of manufacturing defects.
7. Special Orders, Imports and Cancellation Fees
Where you place a special order or any order that requires us to import goods specifically for you — including all orders fulfilled by our international suppliers (Serax, ASA Selection, or others) — the following additional terms apply:
- Once a special order is confirmed and production or procurement has commenced, cancellation may result in a fee reflecting actual costs incurred on your behalf. These costs may include supplier production costs, freight, customs and import duties, and warehousing fees.
- The cancellation fee will be calculated on the basis of documented costs at the time of cancellation and may equal up to 100% of the order value if goods have already been produced or dispatched by the supplier.
- Any deposit paid will be applied against the cancellation fee. If the cancellation fee exceeds the deposit, you will be invoiced for the balance, which is due within 14 days.
This clause is permitted under Section 17(2) of the Consumer Protection Act 68 of 2008, which allows for reasonable cancellation charges reflecting actual costs incurred.
8. Pre-Sale Inspection of Tableware and Glassware
Given the fragile nature of our tableware and glassware products, Nona International inspects all goods before they leave our store or are dispatched. For in-store purchases, you are invited to inspect your items at the point of sale before accepting them.
By accepting your purchase — whether by taking possession in-store, or by confirming receipt of a delivered order without raising a damage complaint within 48 hours — you confirm that the goods were received in good condition. Any breakage or damage arising after acceptance is considered damage that occurred after delivery and does not constitute a manufacturing defect under the Consumer Protection Act.
9. Returns, Exchanges and Refunds
Our returns, exchange and refund policy is governed by our separate Returns, Exchange & Refund Policy (Version 1.1), which is incorporated into these Terms by reference and forms part of this agreement. The Returns Policy is available in-store and at www.nona-international.co.za.
In summary:
- Change-of-mind returns are accepted within 7 calendar days of purchase or confirmed delivery, subject to the item being unused, undamaged, in original packaging, and accompanied by proof of purchase. The remedy is an exchange or credit note (valid for 12 months). No cash or card refund is payable for change-of-mind returns.
- Defective goods: where goods have a manufacturing defect within 6 months of purchase, you are entitled under Section 56 of the CPA to a repair, replacement or full monetary refund at your election.
- Direct marketing cooling-off (CPA Section 16): purchases made as a result of direct marketing contact may be cancelled within 5 business days of delivery for a full refund.
- Special orders, imported and custom items are not eligible for change-of-mind returns.
Nothing in these Terms limits or restricts your statutory rights under the Consumer Protection Act 68 of 2008.
10. Warranties and Implied Terms
All goods sold by Nona International carry the implied warranty of quality as set out in Sections 55 and 56 of the Consumer Protection Act — that goods are of good quality, free of defects, and suitable for their general intended purpose at the time of sale.
Nona International does not provide any additional express warranty beyond what is required by law, unless a manufacturer warranty is included with the product and communicated to you at the time of sale. Manufacturer warranties are subject to the terms of the relevant manufacturer and are separate from your statutory rights.
The following are expressly excluded from any warranty:
- Damage caused by misuse, improper care, accidental breakage, or failure to follow care instructions;
- Normal wear and tear;
- Damage occurring after delivery and acceptance of the goods;
- Goods that have been modified, repaired, or altered by any party other than us.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Nona International’s liability to you in connection with any purchase is limited to the purchase price of the goods giving rise to the claim. We are not liable for any indirect, consequential, special or incidental loss or damage arising from or in connection with your purchase, including but not limited to loss of profit, loss of opportunity, or loss of enjoyment.
Nothing in this clause excludes or limits any liability that cannot be excluded or limited under the Consumer Protection Act or any other applicable South African law.
12. Intellectual Property
All content on our website, including but not limited to text, images, photographs, product descriptions, logos and branding, is the property of Nona International or our licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any such content without our prior written consent.
13. Website Use and Electronic Transactions
Use of our website at www.nona-international.co.za is subject to these Terms and our Privacy Policy. By using our website, you confirm that you are at least 18 years of age, or are acting with the consent of a competent person, and that you have the legal capacity to enter into a binding agreement.
In accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA), we confirm:
- Our full name and registration details are set out in these Terms and on our website;
- Goods are described accurately on our website to the best of our ability;
- Prices are displayed inclusive of VAT;
- You will have the opportunity to review and correct your order before final submission;
- An order confirmation will be sent to the email address you provide;
- We will maintain records of electronic transactions as required by ECTA.
14. Privacy and Personal Information
We collect and process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy (Version 2.0). Our Privacy Policy explains what information we collect, how we use it, how long we retain it, and your rights in relation to your personal information.
Our Privacy Policy is available in-store and at www.nona-international.co.za. By purchasing from us, you acknowledge that you have read and understood our Privacy Policy.
15. Consumer Protection Act Compliance
These Terms are intended to be read and applied in a manner consistent with the Consumer Protection Act 68 of 2008. Where any provision of these Terms is inconsistent with a provision of the CPA, the CPA shall prevail. Where these Terms are silent on a matter governed by the CPA, the CPA shall apply.
Your key CPA rights include:
- The right to receive goods of good quality, free from defects, and fit for purpose (Sections 55 & 56);
- The right to return defective goods and receive a repair, replacement or refund within 6 months of purchase (Section 56);
- The right to cancel a direct marketing purchase within 5 business days of delivery (Section 16);
- The right to cancel a special order subject to reasonable cancellation fees reflecting actual costs (Section 17);
- The right to accurate product information and honest marketing (Sections 22–30);
- The right to fair, reasonable and just contract terms (Section 48).
16. Disputes and Governing Law
16.1 Internal Resolution
If you have a complaint or dispute regarding a purchase, please contact us in the first instance:

We will acknowledge your complaint within 2 business days and aim to provide a resolution within 10 business days.
16.2 External Escalation
If our internal process does not resolve the matter to your satisfaction, you may refer the dispute to:

- Consumer Goods and Services Ombud (CGSO): www.cgso.org.za
16.3 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute that cannot be resolved by agreement or through the external bodies listed above shall be subject to the jurisdiction of the South African courts.
17. General Provisions
17.1 Whole Agreement
These Terms, together with our Returns, Exchange & Refund Policy and our Privacy Policy, constitute the entire agreement between you and Nona International in relation to the sale of goods and supersede all prior representations, agreements or understandings.
17.2 Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
17.3 Waiver
No failure or delay by us in exercising any right under these Terms shall constitute a waiver of that right.
17.4 Changes to These Terms
We may update these Terms from time to time to reflect changes in our business practices, applicable law, or best practice. Updated Terms will be posted on our website with a revised effective date. Your continued purchases after the updated Terms have been posted constitute acceptance of the revised Terms.
